A BRIEF HISTORY
- Lawyers and the first founders of law appeared in Ancient Greece and Rome.
- Ancient Athenians called ‘orators’ would often plead the case of a ‘friend’ because, at the time, the accused and complainant were required to personally plead their case or have a standard citizen or friend plead on their behalf.
- These ancient lawyers weren’t allowed to request a fee for their service. However, the law around fees was often violated but there were no laws prohibiting the practice.
- In ancient Rome, Emperor Claudius eventually legalized the legal community and allowed lawyers (also referred to as advocates) to charge a limited fee.
- Over time, the profession became regulated and a high standard had to be achieved before being allowed to work as a lawyer. As a result, the service was only accessible to the higher classes.
- Soon, lawyers became highly regarded in society for their knowledge of the law. The high standard and respect owed were adapted over the following years.
- In the middle ages, lawyers developed a negative reputation due to supposed incompetence. This led to professionalizing the legal profession and lawyers being made to swear an oath before being allowed to practice law.
GENERAL RESPONSIBILITIES OF A LAWYER
- To provide legal advice or counseling to clients and potential clients.
- To prepare and perform oral arguments or submit written arguments in the courts on behalf of their clients.
- The prosecution and defense of criminal suspects (accused).
- Consultation to review documents such as agreements, leases, wills, corporation documents, and other court forms.
- Mediation, arbitration, or other third-party services are allowed by law or appointed by judges.
- Preparation of documents such as affidavits and complaints.
- Representing clients in court on arbitration, administrative and legislative proceedings.
KINDS OF LAWYERS
- After graduating from law school, lawyers specialize in different areas of the law.
- Labor lawyers – specialize in unlawful layoffs, and workplace cases including wages, severance pay, and other worker’s rights.
- Family Lawyers – handle domestic cases, such as divorce, legal separation, child custody, adoption, paternity, alimony, marriage agreements, child abuse or domestic violence cases, and even juvenile delinquency cases.
- Corporate Lawyers – specialize in building, managing, maintaining, transferring, and dissolving businesses. They also handle employment contracts, tax compliance, acquisitions, mergers, and business disputes.
- Criminal Lawyers – are skilled in handling all stages of a criminal lawsuit. They provide legal service to their clients from the time they are arrested, through the investigation, charging, arraignment and sentencing.
- Constitutional Lawyers – are experts in the Constitution. They ensure that there is a lawful balance between the interests of their clients and those of government institutions.
- Estate Planning Lawyers – handle wills, trusts, and property rights. Their legal advice to clients ensures assets and properties are properly resolved upon their passing.
- Tax Lawyers – along with accountants, make it easy for clients to manage their tax duties especially if they have many assets.
Interesting Fact: Depending on countries and functions, lawyers are known as: barristers, advocates, solicitors, canonists, canon lawyers, civil law notaries, counsel, counselors, solicitors, legal executives, etc.
- Real Estate Lawyers – are experts in laws about buying a home or advising construction companies on various zoning laws. They also handle evictions and foreclosures, representing tenants and property owners alike.
- Other lawyers include Estate Planning Lawyers, Personal Injury Lawyers, Malpractice Lawyers, Immigration Lawyers, Environmental Lawyers, Civil Rights Lawyers, Intellectual Property Lawyers, Government Lawyers, Military Lawyers, etc.
SOME FAMOUS LAWYERS
- Many lawyers venture into other professional fields and even politics. Some of them are world-renowned leaders:
- Barack Obama – from Civil Rights Lawyer to President of the United States (2009–2017).
- Mahatma Gandhi – from a lawyer for 25 years to a Civil Rights leader of India who led his country to freedom from British colonial rule.
- Nelson Mandela – founded South Africa’s first black law firm and then became President of South Africa (1994–1999).
- Vladimir Putin – from law graduate to soldier and then Russia’s longest-serving President from 1999 to the present.
- Tony Blair – from Labour Party barrister to British Prime Minister (1997–2007).
- Sandra Day O’Connor – from Assistant Attorney General of Arizona to deputy county attorney then the first-ever female Justice of the United States Supreme Court.
- Mary Robinson – from local barrister to the first woman President of Ireland and former UN High Commissioner for Human Rights and Chair of The Elders.
